Recovery Agent is a trading name and product of Proja AI Ltd, Company No. 16963746, registered in England and Wales ("we", "us"). These terms apply to the Recovery Agent platform and services.
1. Services
Recovery Agent provides a human-led, agent-assisted financial and commercial recovery service supported by the Recovery Agent platform. The specific scope, deliverables, fees and authorities for any engagement are set out in signed engagement terms, which take precedence over these Terms where they conflict.
2. What the service is not
Recovery Agent is not a debt-collection agency, statutory auditor, accounting firm or law firm. Nothing provided through the platform constitutes legal, tax, accounting or regulatory advice. Where specialist advice is required, we will recommend referral to an appropriately qualified adviser.
3. Human control
No case, notice or correspondence is issued to a counterparty without approval by an authorised user. Automated agents produce drafts and findings only. The customer retains control over which matters are pursued and over any settlement.
4. Customer responsibilities
The customer is responsible for the accuracy and completeness of records supplied, for having the right to supply them, for nominating approvers and thresholds, and for confirming protected relationships and do-not-contact counterparties before external activity begins.
5. Fees
Fees are calculated in accordance with the engagement terms. Success fees apply only to confirmed fee-eligible recovery supported by evidence. Avoided future leakage is an estimate and is never fee-eligible. Fee statements are issued for approval before invoicing.
6. No guarantee of outcome
Recovery outcomes depend on data availability, contract terms, time bars and counterparty behaviour. We do not guarantee that any identified value will be recovered or that any entitlement exists.
7. Liability
Nothing limits liability for death or personal injury caused by negligence, fraud or any liability that cannot be limited by law. Subject to that, liability is limited as set out in the engagement terms.
8. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
